Dinamika Sistem Online Single Submission (OSS) Sebagai Solusi Kebijakan Perizinan Usaha Berbasis Risiko Terhadap Terpenuhinya Pelayanan Publik

Abstract

ABSTRACT: PP Number 5/2021 concerning Risk-Based Business Licensing and PP Number 6/2021 concerning Implementation of Business Licensing in the Regions with the Online Single Submission (OSS) system become PP of the Job Creation Law. The aim of the research is to analyze the application of licensing with the OSS system in accordance with the conditions of the Indonesian constitution. The benefits of this research are to contribute thoughts and guidelines for those who wish to study in the field of law and licensing law for the OSS system. The research method is normative legal research. Even though the implementation of the OSS system aims to be effective and utilize technology, if it is related to the constitutional conditions in Indonesia, the system should not be implemented as a whole but needs to be changed because services are still needed directly. Conclusions and suggestions, the concept of public service, in this case the Risk-Based Business Licensing with the OSS system, although it is a concept that has just been implemented in Indonesia, because it can create information transparency and close opportunities for KKN. The OSS system should be determined at the center but left to the local government.

ABSTRAK: PP Nomor 5/2021 tentang Perizinan Berusaha Berbasis Risiko dan PP Nomor 6/2021 Tentang Penyelenggaraan Perizinan Berusaha di Daerah dengan sistem Online Single Submission (OSS) menjadi PP dari UU Cipta Kerja. Tujuan penelitian, untuk menganalisis penerapan perizinan dengan sistem OSS sesuai dengan kondisi ketatanegaraan Indonesia. Manfaat penelitian memberikan konstribusi pemikiran dan pedoman bagi yang ingin mengkaji di bidang hukum dan hukum perizinan sistem OSS. Metode penelitian adalah penelitian hukum normatif. Meskipun penerapan sistem OSS bertujuan untuk efektivitas dan memanfaatkan teknologi, namun bila dikaitkan kondisi ketatanegaraan di Indonesia, sistem tersebut seharusnya tidak serta merta diterapkan secara menyeluruh melainkan perlu perubahan karena masih dibutuhkan pelayanan secara langsung. Kesimpulan dan saran, konsep pelayanan publik dalam hal ini Perizinan Berusaha Berbasis Risiko dengan sistem OSS meskipun merupakan suatu konsep yang baru diterapkan di Indonesia karena dapat menciptakan transparansi informasi serta menutup peluang terjadinya KKN. Seharusnya sistem OSS ditentukan di pusat melainkan diserahkan kepada pemerintah daerah.
